Construction debris continues to be removed via the east side of Seventh Avenue, the north side of 11th Street and the south side of 12th Street. Asbestos containing materials are being bagged and then removed from Seventh Avenue only. We have added "misters" to the debris removal exit points on 11th Street as well as maintaining the program of wetting down the debris at the containers.
Following a meeting with administrators and parents of PS 41, we also agreed to stop the delivery and pick up by trucks of the large construction debris containers on 11th Street between the hours of 8:00 and 9:30 am and 2:30 and 3:30 pm when PS41 is open until the last day of school. The sidewalks on the south side of 12th Street and the north side of 11th Street have now both been closed. Also, an additional crossing guard at 11th Street and 7th Avenue has been added.
Around July 10th, an underground fuel storage tank will be removed from under the sidewalk in front of the Reiss building on 12th street. 3rd party monitors will be onsite during the entire removal to monitor the procedure. Due to environmental and worker safety regulations, workmen will be in protective gear when required. As we get closer to the date, we will confirm the date of removal.

Re: Questions from PS41 Administrators and Parents

1. The developer should provide copies or access to the environmental phase 1 and, if done, phase 2 audits. These reports are prepared by independent environmental engineering firms and provide information on the risk of soil and ground water contamination on the properties. This is important information in that disturbing contaminated soil is a risk factor for exposure. It can also provide information on chemical contamination of ground water and the possible impact on the school.
Response: The Phase I and Phase II reports are included in Chapter 10, Hazardous Materials, of the FEIS.

2. What is the time line on the construction and demolition and the hours that work will take place?
Response: Demolition will extend into mid-2013 and construction will extend into mid-2016. Work is permitted from 8am – 6pm, Monday thru Friday. After-hours and weekend work will be permitted by special permit only.

3. Will exits and entrances at PS 41 be impacted?
Response: No

4. Provide information on the asbestos work to be performed in each building and the anticipated timing?
Response: Asbestos removal work of pipe and ductwork insulation, floor tiles, and mastic is being done in conjunction with demolition through 2013.

5. Who is performing the asbestos work?
Response: LVI Environmental Services Inc.

6. What firm is monitoring the asbestos work?
Response: Advanced Environmental Corp.

7. Are PCB’s present in the buildings and how and when are materials containing PCBs be removed?
Response: Fluorescent light fixtures are present within the existing buildings. The majority of the fixtures have been removed, packaged and shipped to proper material handling and disposal facilities. The remainder will be disposed of in the same way.

8. Are there hazardous materials that require removal or excavation such as fuel oil storage tanks and contaminated soil?
Response: There are two underground fuel oil storage tanks that will require excavation and removal, one in the sub-cellar of the Coleman Building and one under the sidewalk on 12th Street. All reports indicate that the tanks have not leaked. Removals will be conducted and documented per the appropriate agency guidelines.

9. Will lead based paint be disturbed and what testing and monitoring will be done to characterize levels of lead dust in air? Is there a written lead exposure plan for the project? Are contractors certified renovators as required under US EPA lead paint rules?
Response: The old Saint Vincent’s facility has lead based paint in limited locations. As such there are two agencies that have oversight of the project: the EPA and OSHA.

In accordance with the Resource Conservation & Recovery Act (RCRA) requirements, the project, using a Certified Industrial Hygienist (CIH), conducted Toxicity Characterization Leaching Procedure (TCLP) samples on the waste stream for the buildings. All TCLP samples came back within acceptable criteria-thus allowing the waste to be disposed of as general construction and demolition waste.

Following the criteria set forth in the EPA regulations 40 CFR 745, Turner Construction, and its subcontractor, LVI, are EPA Lead Renovator certified. Both Turner and LVI have EPA Lead Renovator trained employees on the jobsite.

In accordance with OSHA regulations 29 CFR 1926.62 personal sampling for lead has been conducted on workers performing the demolition. All exposures consistently come back below the Action Level (AL) and the Permissible Exposure Limit (PEL).

10. Is there a written health and safety plan for the project (CHASP)?
Response: Yes. The document is described in Chapter 10 of the FEIS. The CHASP was approved by the DEP on December 12, 2011.

11. What precautions are planned to control dust?
Response: A NYC DEP dust mitigation plan has been completed. The components of the program applicable to this phase of demolition are being met. Load out debris going into packers and dumpsters are being wetted with handheld hoses prior to placing the debris into the interior waste chutes and again at the first floor debris storage areas prior to load out. Street and sidewalks impacted by these operations are swept clean as required through the day and are left clean at the end of the work day.

12. How will cleaning be addresses for any dust that impacts adjacent property such as PS 41?
Response: We anticipate a successful Dust Mitigation Plan requiring no clean up of adjacent properties.

13. The NYC DEP community noise standard requires that parties responsible for construction projects must design and implement a noise mitigation plan that is specifically designed for a sensitive receptor, such as schools or hospitals. See NYC DEP community noise fact sheet on their web site. This is a very strict standard and we can measure sound levels using a calibrated OSHA type 2 sound level meter at the property line. It is very easy to exceed 10 decibels over ambient background. We are most concerned with excessive levels inside the school at an open window.
Response: The Restrictive Declaration has established mitigating measures that will be put into place. These measures will include:
- Plywood sound barriers on construction fencing on 11th & 12th Streets and Seventh Avenue.
- Acoustical barriers will be placed around noise-generating equipment within the site.
- Work beginning at 8:00am instead of the more common construction start time of 7:00am.
- Monitoring of these measures has, and will continue to be, conducted on the site.

14. Is there a central location where all material safety data sheets are maintained for chemical products that will be used during the building and construction phases?
Response: Yes. They can be viewed by contacting Turner Construction at 646-707-0080.

15. Has the contractor worked out a procedure for school test dates and noise?
Response: The project team will work with the school to ensure there will not be any negative impact.

16. Will construction vehicle traffic impact the school? How will traffic be controlled?
Response: As we bring on other subcontractors, their contracts will require slower speed limits within the block of the project (11th and 12th Streets between Sixth & Seventh Avenues). All truck traffic will be directed onto the site by flagmen.

17. What measures will be taken to secure the site and any waste dumpsters?
Response: All construction activities and dumpsters will be contained within the locked fence surrounding the site. In addition, there will be security guards patrolling the site during off-hours.

18. Will environmental monitoring be done and who is the independent firm that conducts monitoring?
Response: Ownership has retained an Independent Monitor, HDR Inc., as stipulated by the Restrictive Declaration. Their role is to provide oversight over the entire construction process and report to City Planning. Independent from HDR, and as mentioned previously in response to #6, we have retained Advanced Environmental to monitor the asbestos abatement. Additionally when we start excavation work, we will retain a monitor for the soil removal.

June 7, 2012

On Saturday June 9th (8 AM to 6 PM) and Sunday June 10th (9 AM to 6 PM), Metropolitan Water & Sewer Co. will be installing a water valve off of a main water line below 7th Avenue near the intersection of 7th Avenue and 12th Street. All work will performed in accordance with the regulatory requirements of the NYC Depts. of Environmental Protect, Buildings and Transportation.

Re: West Village Residences Construction Protection Plan Monitoring

Dear Owner,
As set forth in the proposed project’s Final Environmental Impact Statement (FEIS), a Construction Protection Plan (CPP) is required to avoid adverse physical impacts on historic architectural resources that are located close enough (within 90 feet) to the proposed project to be potentially affected by staging, deconstruction, and construction period activities. Over the next couple days, you will notice individuals, hired by West Village Residences LLC (“WVR”), who will begin a preliminary preconstruction survey of the exterior of your property to ascertain any pre-existing damage, existing structural distress, and any potential weakness of the foundations or structures.
In addition to the preliminary preconstruction survey, it is possible that there may be a need for a further construction protection plan inspection that will be undertaken by the CPP Inspecting Engineer. The inspection may include all exterior areas from the ground floor level to the roof and may include sidewalks, curbs, setbacks, parapets and coping as well as an interior inspection, to be limited to accessible public ground floor areas, e.g., lobbies and subgrade areas as applicable. If access is required, we will contact you to arrange desired access.
In the near future, WVR and WVR’s construction manager will be performing various preconstruction surveys of your property to help further protect your property as well as WVRs. If access is desired, we will contact you under separate cover.
In advance, thank you for your cooperation in this matter.
Sincerely,
John Gilbert

Interior demolition and abatement continue on a daily basis. Construction debris is being removed via the east side of Seventh Avenue, the north side of 11th Street and the south side of 12th Street. Asbestos containing materials are being bagged and then removed from Seventh Avenue only. We have added "misters" to the debris removal exit points on 11th Street as well as maintaining the program of wetting down the debris at the containers.
The NYC DOT has approved the sidewalk closing of both 11th and 12th Streets. Our plan is to close the sidewalk adjacent to our site on the north side of 11th Street Tuesday morning, June 5th at 8 AM and the sidewalk adjacent to our site on the south side of 12th Street Thursday morning, June 7th at 8 AM. We have also been pursuing a request for additional crossing guards at 11th Street and 7th Avenue. We have applied for an additional guard for the Fall and have also been informed that an additional guard will be present for the last three weeks of this school year starting Monday, June 4th.

As we previously discussed, interior demolition and abatement continue on a daily basis. Construction debris is being removed via the east side of Seventh Avenue, the north side of 11th Street and the south side of 12th Street. Asbestos containing materials are being bagged and then removed from Seventh Avenue only. The lane closures on 11th and 12th Streets will continue as needed for now, but we expect to close parking lanes and sidewalks adjacent to the construction site, in the coming weeks. In regards to the east side of Seventh Avenue, we are approaching NYC-DOT again, asking to allow the pedestrian lane in the street to be closed. We believe this will provide greater safety for pedestrians.
In response to concerns raised in a meeting with Kelly Shannon, the principal of PS 41, and parents of students on Friday May 18, we will also refrain from trucking out of the project from 8 am to 9:30 am and 2:30 pm to 3:30 pm from 7th avenue and 11th street, when school children are arriving and leaving for the school day.

Current Conditions and Future Activities –
As we previously discussed, interior demolition and abatement continue on a daily basis. Construction debris is being removed via the east side of Seventh Avenue, the north side of 11th Street and the south side of 12th Street. The lane closures on 11th and 12th Streets will continue as needed for now, but we expect to close parking lanes and sidewalks adjacent to the construction site, within the next month. Several people in the community have raised the issue of pedestrian safety on the east side of Seventh Avenue. We have added another flagman who is equipped with a radio to insure the safety of everyone on this sidewalk. Importantly, we have approached NYC-DOT and asked them to allow for this sidewalk to be closed. They denied this initial request. However, if the community agrees that this sidewalk should be closed, we are willing to go back to NYC-DOT and resubmit this request.

April 19, 2012

Dear All:
I am writing to inform you that NYC DOT has approved parking lane closings on the north side of 11th Street and the south side of 12th Street east of Seventh Avenue for the duration of our project. The purpose of these closings is to safely facilitate the removal of construction debris. You may see these lanes closed early next week in anticipation of construction activity around mid-week. Please note that although we have approval to shut down the entire lane, we will limit these closures to space in front of Reiss and Nurses on 12th Street and the Cronin Building on 11th Street. As construction activity begins to ramp up, we will need to close the entire lane and will inform you accordingly when this happens. Thank you for your attention to this matter. Please let me know if you have any questions.
